1. Scope of Application and Contract Conclusion
These Terms and Conditions apply to all contracts between Bearcatdock GmbH, Landstraße 142, 4020 Linz, and its clients. A binding contract is established only when Bearcatdock sends a formal order confirmation after reviewing the project requirements. These terms are supplemented by our Privacy Policy.
2. Services and Order Process
The subject of the contract is the artisanal execution of bookbinding, restoration, and the creation of handmade notebooks according to the agreed specifications. The client is responsible for providing all necessary information and materials in a timely manner to ensure the quality of the craft.
3. Pricing, Taxes, and Payment Terms
All prices are stated in Euro and include the statutory Austrian Value Added Tax (VAT) of 20%. Any price adjustments due to significant increases in raw material costs will be communicated in advance. For business customers (B2B), a payment period of 14 days from the invoice date applies.
4. Deposits, Urgency, and Cancellations
To secure the order and materials, a deposit of 30% of the estimated total value is required. For urgent orders, an express surcharge of 50% on the standard price will be applied. In accordance with the Consumer Protection Act (KSchG) and the Distance and Off-Premises Contracts Act (FAGG), the right of withdrawal is excluded for custom-made goods (bespoke items) once the production process—specifically the cutting of materials—has begun.
5. Lead Times and Storage
The average lead time for projects is between 3 and 6 weeks. Clients will be notified immediately upon completion. If the finished work is not collected within 30 days following notification, Bearcatdock GmbH reserves the right to charge a storage fee or, after written warning, to dispose of the item.
6. Ownership and Intellectual Property
The client confirms that they hold all necessary rights to the texts and images submitted for binding. Bearcatdock GmbH assumes no liability for copyright infringements committed by the client. The final product passes into the ownership of the client only upon full payment of the invoice.
7. Liability and Warranty
Bearcatdock GmbH is liable for the careful storage of originals during the processing period. Liability for the natural aging processes of historical papers or leather is excluded. Warranties for artisanal services are governed by the statutory provisions of Austrian law.
8. Final Provisions and Jurisdiction
Should any individual provision of these terms be invalid, the validity of the remaining provisions remains unaffected. Austrian law applies. The place of jurisdiction for all disputes is Linz. For data protection concerns, clients may contact the Austrian Data Protection Authority (DSB), Barichgasse 40-42, 1030 Vienna (see Privacy Art. 12).
